During the trial, the prosecution presented five witnesses, while the court relied on the child\u2019s testimony and medical evidence to find Kutu guilty beyond reasonable doubt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court dismissed Kutu\u2019s defence that he had been framed, saying there was no apparent reason for the child to falsely accuse him. The evidence presented during the trial supported the court\u2019s decision to convict him.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A victim impact statement and a pre-sentence report indicated that the child suffered trauma and nightmares following the incident. The report also stated that the pupil was later transferred to another school to protect her safety.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Despite Kutu being a first-time offender with a positive school record, the magistrate ruled that the law provides for life imprisonment for defilement involving a child aged 11 years or below..<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kutu had been in custody since October 15, 2025, as the case proceeded through court. Following the ruling, he was given 14 days to appeal the sentence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ruling highlights the serious legal consequences of sexual offences against children and the importance of protecting learners in schools and other learning environments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case has also drawn attention to the need for safe school environments where children can learn without fear of abuse.
